Photography Services Agreement

This agreement constitutes an order for photography services. These services include the provision of a photographer/s for on-location shooting on the day of your shoot, and post-production and editing services of the images post-shoot. By signing this form, I agree to adhere to the following terms and conditions. I understand these terms of service are legally binding and represent an agreement between myself (‘the client’) and Bridget Wood Photography (‘BWP’ or ‘the provider’).

1. This agreement takes full force and effect from the date the client advises the provider they wish to confirm an order for services.
2. To confirm a booking, the client must:
   • a) Complete, sign, and deliver a booking agreement to the provider, and
   • b) Provide a session fee of $550 ex GST to the provider.
3. On receipt of the completed and signed booking agreement, and the $550 GST session fee, BWP will provide a tax receipt to the client and reserve the time and date agreed upon for the photo shoot.
4. Due to the opportunity cost of marketing available dates to prospective clients, the session fee is strictly non-refundable.
5. The full fee agreed upon for the provision of photography services, less the booking deposit amount, is due one week in advance of the shoot date. This includes any additional fees that have been agreed upon, such as travel and accommodation if applicable.
6. Cancellation/Refund Policy:
   • a) The session fee is non-refundable.
   • b) If the client needs to reschedule, they must provide at least 48 hours’ notice. Rescheduling is subject to availability and may incur additional fees.
   • c) In the event that BWP cannot provide services as detailed in the agreed quote due to circumstances outside the control of BWP, any fees previously paid to BWP by the client will be returned, but BWP shall have no further liability with respect to this agreement.
7. BWP agrees to transfer ownership of the images to the client upon delivery of the finished images to the client. However, BWP retains the right to use the images for promotional purposes of the BWP business, including on the BWP website, social media, and in advertising and marketing materials.
8. Although utmost care will be taken with digital files, BWP limits any liability for loss, damage, injury, or failure to deliver pictures for any reason, to the return of payments made. The limit of liability for a partial loss of digital files shall be a prorated amount of the images lost based on the percentage of the total number of digital files.
9. Ordering Session and Final Payment:
   • a) An ordering session will be scheduled within two weeks after the photo shoot. During this session, the client will select the images and products they wish to purchase.
   • b) Full payment for the selected images and products is required at the end of the ordering session. BWP will not begin processing orders until payment is received in full.
   • c) All decisions made during the ordering session are final. No changes or cancellations are permitted once the order is placed, and no refunds will be provided.
10. I understand that all decisions are final and no refunds will be provided once products have been exchanged.
11. Non-Payment Clause:In the event the Client fails to make any of the scheduled payments as per the agreed payment plan, or if the Client’s payment method is withdrawn, declined, or charged back, Bridget Wood Photography (“BWP”) reserves the right to pursue immediate payment of the outstanding balance. If the Client has not paid within five (5) days of the payment due date, the Client will be in default and breach of this Agreement.At its discretion, BWP may terminate this Agreement, refer all unpaid amounts to a collection agency, and/or pursue any other legal remedy available to collect the unpaid balance in full. Any unpaid past due amounts will incur the highest interest rate permissible by law, and the Client will be responsible for all fees and costs associated with collection, including attorney’s fees.
